Noise complaint results in alcohol tickets for men

LOGAN–Two police officers responded to a noise problem Thursday night in the area of 400 East and 300 South. Officers discovered that the noise came from a loud car stereo.

“From a distance away they could hear the vehicle and they were able to zero in on them easily,” Lt. Brad Franke of Logan City Police Department said.

Officers found two open containers of alcohol in the vehicle, and found that both persons had been drinking.

The driver of the vehicle, a 33-year-old male from Logan, had the keys in the ignition, with another 33-year-old male from Logan in the vehicle.
The men told the officers they had left a party to smoke a cigarette outside, Franke explained. They only went into the car because they were cold.

The officers decided not to arrest the driver for a DUI. The two occupants of the vehicle were issued misdemeanor citations for having open containers of alcohol in the car.

“It’s at the officers’ discretion based on the circumstances,” said Franke about whether to arrest a suspect of not. “I’m surprised he didn’t take the guy to jail. [That officer] is one of our DUI guys, so for them there must have been specifics.”
