Judge sentences man to a year in jail for assault

LOGAN – First District Court Judge Kevin Allen made it clear in his courtroom Monday that violent crimes are taken extremely seriously. “You’re fortunate somebody didn’t get hurt,” Allen told José Gutierrez, who was in court to be sentenced. “I don’t understand how you could do that.”
Gutierrez was sentenced to serve 364 days in the Cache County Jail for assault involving domestic violence, a Class A misdemeanor. He was also fined $1,000 and ordered to take an anger management course. He was originally charged in April with two additional counts of aggravated assault, both of which were dismissed in a plea bargain made on Sept. 16 in exchange for his guilty plea.
Defense attorney Bryan Galloway told the court Gutierrez felt remorse for his actions, and requested a shorter sentence. The judge denied the request but credited Gutierrez with the 66 days he has already spent in jail.
Allen also granted Gutierrez work release in order to sustain his family. He ordered Gutierrez to report to the jail Saturday at 9 a.m.
