LOGAN — A Logan man was sentenced in 1st District Court Monday to spend 15 years to life in prison for the aggravated sexual abuse of a child.

Efrain Marty Ruiz will likely live out his remaining years behind bars, after being convicted of molesting and raping a teenaged girl for three years, from the time she was 12 until she turned 15. Ruiz entered a guilty plea in the hopes to have possible parole during his sentence. His attorney, Wayne K. Caldwell, said Ruiz had a methamphetamine addiction while the assaults were going on and was not in his normal state of mind.

“I have never been in trouble before,” Ruiz told Judge Kevin Allen. “I am 57 years old and I don’t have many years left,”

Cache County Prosecutor Spencer Walsh refuted Ruiz’s request and recommended he be given the maximum punishment. Ruiz occupied a position of trust in the victim’s life, Walsh said, and forced her to perform sex acts. “He also told the victim that their relationship was ordained by God.”

The words were stark as Judge Allen addressed Ruiz’ request for possible parole and handed down the sentence.

“You ask me to show you mercy — three years you did not show her mercy as you raped and molested her? You are a pedophile and will receive no mercy from me,” Allen said. “You said your behavior didn’t bother her, it bothered her boyfriend. For you to say that is disturbing.”

Allen gave Ruiz the maximum punishment for the charges against him. “You will live out your remaining years in the Utah State Prison,” Allen said.
