Dispute over annexation gets County Council to table decision

LOGAN–An annexing and agricultural protection dispute between two families was tabled for another two weeks at Tuesday night’s Cache County Council meeting, after a heated discussion over the property.

The area of land is 8.24 acres near Nibley. The Schiess family would not mind their property becoming part of Nibley if they would be allowed agricultural protection. This would mean the property would not have to have any roads or infrastructure put there if the family didn’t want there to be.
Ryan Petersen remarked, “We want to protect our development rights. The council should hold off so our annex petition is heard.”

Amy Schiess stated their family’s only concern was if they allowed an annexation to go through could they take on an agricultural protection and still let the land become part of Nibley City.

The Schiess family grows hay and raises cattle on their land. Amy Schiess said her father, Boyd Schiess, expressed in a phone call that he is just afraid of losing his rights if he allows the Petersen’s annex petition to go through.

A big part of the discussion is if they allow Nibley to do the annexing, will the city allow the family any agricultural protection or even put it down in writing and not go back on their word later on.

Wendy Petersen said, “Look at what could happen to our property. We have no problem with an APA and if they apply to Nibley City rules,” she said.

Councilmen Cory Yeates recommended the two families get together, work out a deal and get with in touch with Nibley. The hearing has been set aside for two weeks for the families to come back with a written and signed agreement.

In other business, the council settled on allowing the Wellsville Tabernacle to use part of its $35,000 grant meant for heating and cooling repairs to be used on repairing the attic.

The council also agreed on the S Curve Subdivision in Benson having two plots of land for building and the rest for agriculture. This topic had been a big issue for the past month and it was pushed through the meeting quickly.
