Smithfield man sentenced on rioting charge

LOGAN— Jesus Patino, 21, of Smithfield was sentenced to 45 days in jail in 1st District Court on Monday.
Patino was charged with rioting, a 3rd degree felony, on Sept. 1. During the riot Patino’s anger turned to violence, and he injured someone pretty severely, said prosecuting attorney Andrew McAdams.
Judge Kevin Allen sentenced Patino to 45 days in Cache County Jail with work release. Patino will also be required to participate in anger management therapy, write a letter of apology to the victim and pay $3,500 in fines and fees.
Patino’s defense attorney, Dennis Mathews, tried to get him a milder sentence. Mathews said that Patino’s brother had a similar charge and received a milder sentence. He also said that Patino comes from a good family and has a lot of support.
When Allen asked McAdams for his thoughts on a milder sentence, McAdams said that he was concerned that Patino wasn’t taking responsibility for his actions. McAdams reiterated that the injury Patino inflicted was fairly severe and that he shouldn’t receive too mild of a sentence.
