Water shares attach to property, not owners, says Hyde Park P&Z

HYDE PARK–Planning and Zoning Commission Chairman Reed Elder said Wednesday he wants to clarify the requirement that shares for secondary water are tied to a property, not to the owner of a property.

After recent difficulties with water shares, the commission discussed changing the wording in the subdivision ordinance to prevent confusion about requirements for secondary irrigation water, ensuring that shares for the water remain with a property.

“We want to have strong enough language that a subdivider couldn’t sidestep and take water from lots,” said Elder, adding that the commission should “put more clarification in the ordinance, so we don’t end up dancing to get what we want.”

Also during the meeting, Mark Lynne presented an outline for the mixed-use ordinance the commission has been planning. “There’s a lot of detail to be put into this,” Lynne said. “I need more time to refine it.”

David James said he thought the commission should make big decisions about the ordinance first, like whether they should allow townhouses or stacked buildings, before dealing with small details.
